General Conditions and Cancellation Policy

1.Cancellation conditions

Reservation changes: You can change your reservation at any time without penalty. The only condition is that the total cost must be equal to or greater than the original reservation.

2. Insurance coverage

• Our rates always include comprehensive insurance with a deductible, which is indicated for each model and in the reservation. In the event of an accident, it will cover damage to third parties and damage to the rental vehicle itself, starting from the deductible (due to side impact and/or collision).
• Our client will be responsible for any damage to the vehicle up to the maximum amount of the contracted deductible (which can be cancelled upon signing the contract or reservation at an additional cost).
• The deductible is applicable per accident and/or per side. If the vehicle suffers two accidents, two franchises will be applied.
• Under no circumstances are damages covered: underbody, wheel, or rim damage, lost or broken keys, burnt clutch, damage caused to the vehicle through negligence, incorrect refueling, and/or damage caused by an unauthorized driver.

3.Other expenses not included

• Administrative fees for processing fines or penalties of any kind arising from the rental.
• Cleaning charge for a Vehicle returned in an unacceptable state of soiling (beyond that resulting from ordinary use).

4.Fuel Policy

We apply a full-to-full policy. If the vehicle is not returned with a full tank of fuel, a price per liter always higher than the current market price will be charged due to management costs.

5.Requirements for rent

Failure to submit the minimum required documentation will be the customer’s responsibility, and may result in cancellation without prior notice (we recommend checking in online or at the office prior to booking to ensure everything is correct).

Minimum documentation required:

• Valid driver’s license.
• Valid physical DNI/NIE/Passport.
• Credit or debit card in the cardholder’s name to pay the deposit. This will be charged and returned upon return of the vehicle if all conditions are met (no damage, full tank, no overtime, and the vehicle is returned on the agreed date).

Drivers who do not meet the following rental conditions will not be rented:

• Be 23 years of age or older.
• Have at least 2 years of experience with a “B” license valid in Spain.
• Do not show any signs of being under the influence of alcohol or drugs, nor display a threatening or abusive attitude.

If the client does not have the necessary documentation and/or does not meet the conditions, the rental transfer will be facilitated to another holder who does meet the requirements, free of charge. This new holder will be responsible for the deposit and ultimately responsible for the rental contract.

If the reservation cannot be transferred to another eligible holder, it will be considered the customer’s fault, and the cancellation policy for reservations with short notice will apply (cancellation without refund, with the option to postpone the reservation for the following 12 months from the date of the failed delivery).

6. Returning the vehicle to other offices

The return of the vehicle in another office can have a supplement. On our online reservation form, customers can check the final price and make a reservation with a return to another location.

If the customer has not booked a return to another office, prior authorization from Davima is required.

7. Driving outside national territory

Travel outside the country will only be permitted with prior notification to the office and the purchase of EU international insurance.

8. Compliance with Royal Decree 933/2021

In compliance with Royal Decree 933/2021 of October 26, DAVIMA MOTORS, S.L. may register and communicate certain personal data and information about the rental transaction to the State Security Forces and Corps. This processing is mandatory and is based on compliance with a legal obligation.

9. Protection of personal data

The processing of personal data carried out through this website is governed by the provisions of the Privacy Policy, prepared in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on Data Protection and Guarantee of Digital Rights (LOPDGDD).

10. Civil liability

The company will not be liable for any thefts caused by the loss of personal belongings in the car, nor for any indirect losses (such as loss of profits, loss of enjoyment, or loss of opportunity).
